In 2016, there were over 29 million emergency room visits and nearly 170,000 deaths due to unintentional injuries. Many of these may have been due to a defective product.
Generally, there are three categories of product defects: design defects, manufacturing defects, and marketing defecting. A product has a design defect when the product is made to its specifications, but the product is nonetheless unreasonably dangerous. A product has a manufacturing defect when the product is not made to its specifications, and the product is unreasonably dangerous. Finally, a product has a marketing defect when the product is sold without adequate warnings making the product unreasonably dangerous. A product can have a design defect, a manufacturing defect, and a marketing defect, two, or only one defect. Compared to negligence, which focuses on the offending party’s conduct, products liability is not concerned with the corporation’s intent. If the product is unreasonably dangerous by way of its design, manufacturing, and or marketing, even if the corporation had the best intentions, the product is defective. Finally, a product does not have to be recalled for it to be defective.
